Course Terms and Conditions

These Course Terms and Conditions ("Terms") apply to every product sold by FOCUSED by John Kaplar LLC, a Virginia limited liability company doing business as FOCUSED SketchUp ("FOCUSED SketchUp," "we," "us," "our"), including the FOCUSED Pro membership, individual courses, the FOCUSED 3D Library, and products we sold in the past such as the All-Access Pass, bundles, and the Future-Proof annual subscription (collectively, the "Products"). By purchasing or accessing any Product you agree to these Terms, our Site Terms of Service, and our Privacy Policy.

Change of ownership. On October 14, 2026, the FOCUSED SketchUp business was transferred from 1021 Home, LLC to FOCUSED by John Kaplar LLC. Products purchased before that date were sold by 1021 Home, LLC; FOCUSED by John Kaplar LLC now provides access to and support for them under these Terms. Nothing changes about your access.

1. Eligibility

You must be at least 18 years old to purchase or access any Product. By placing an order you confirm that you meet this requirement and have the legal authority to agree to these Terms.

2. License to Use Course Materials

When you purchase a Product, we grant you a personal, non-exclusive, non-transferable, revocable license to access and use the videos, downloads, models, materials, templates, and other content included with that Product (the "Materials") for your own learning and professional design work.

You may not:

• Share your account credentials or grant access to anyone else.
• Copy, redistribute, resell, sublicense, post publicly, or repackage any portion of the Materials.
• Use the Materials to build a competing course, training program, or asset library.
• Scrape, mirror, or otherwise extract the Materials by automated means.

Designs, renders, and client deliverables you create using the Materials are yours to use commercially. The Materials themselves remain our property.

3. FOCUSED Pro Membership

FOCUSED Pro is a membership that gives you access to every FOCUSED SketchUp course in our active catalog, including new courses as we release them, plus the Replay Video Vault, the printable course guides, and the student community. The FOCUSED 3D Library and our SketchUp extensions are separate products and are not included in FOCUSED Pro.

FOCUSED Pro is offered on three plans. The current prices are shown on the FOCUSED Pro page and confirmed at checkout.

• Monthly: a one-time access fee charged with your first payment, plus a monthly membership fee. The monthly fee renews automatically each month until you cancel.
• Yearly: a yearly membership fee, with no access fee. It renews automatically each year until you cancel.
• Lifetime: a single payment. Lifetime means access for the life of the courses: for as long as we offer FOCUSED courses, including courses we add later. It does not renew.

Automatic renewal. Monthly and Yearly plans renew automatically at the then-current price for your plan, charged to the payment method on file, until you cancel. We will tell you by email before any price change takes effect on your plan.

Cancelling. You can cancel a Monthly or Yearly plan at any time from the Billing page of your account in the FOCUSED SketchUp Learn portal, or by emailing support@focusedsketchup.com. Your plan will not renew, and your access continues through the end of the period you have already paid for. When that period ends, your access to FOCUSED Pro, including every course, the Replay Video Vault, the guides, and the community, ends. If you rejoin later on the Monthly plan, the access fee applies again.

Credit for past purchases. If you bought FOCUSED courses before joining, we may credit what you spent against the Monthly plan's access fee, as described on the FOCUSED Pro page. The credit applies only to the access fee, has no cash value, and is not refundable on its own.

Courses bought before FOCUSED Pro

If you bought an individual course, a bundle, or the All-Access Pass, you keep the access you bought: self-paced, lifetime access for the life of the course. You can start any time, take as long as you need, and revisit the lessons whenever you want. There are no completion requirements and no certificate of completion is issued. An All-Access Pass covers every course that was available on your purchase date, plus the FOCUSED 3D Library where it was included. A Future-Proof subscription gives you access to courses released while it is active, for as long as it stays active.

"Lifetime access" and "the life of the courses" mean access for as long as a course remains part of our active catalog. Software, plugins, and design workflows evolve, and from time to time we may retire a course that has become obsolete or that we no longer have the rights to distribute. If we retire a course, we'll notify enrolled students by email and, where possible, provide a successor course or replacement materials.

The FOCUSED 3D Library is available as a separate monthly or yearly membership, and was included with the All-Access Pass and certain bundles sold in the past. License terms for individual library packs apply to your use of those models.

4. Refund Policy

Our refund windows are based on the date of your order confirmation:

• FOCUSED Pro (Monthly, Yearly, and Lifetime): 14 calendar days from your first payment, no questions asked. On the Monthly plan this covers your first payment, including the access fee. Later monthly or yearly renewal payments are not refundable; cancel before your next renewal date to stop future charges.
• Individual courses and bundles: 14 calendar days, no questions asked.
• All-Access Pass (past purchases): 3 calendar days, no questions asked.
• FOCUSED 3D Library and individual library packs: non-refundable.

To request a refund, email support@focusedsketchup.com from the address you used at checkout, before the applicable window closes. Refunds are issued to the original payment method, and a refunded FOCUSED Pro membership ends when the refund is issued.

Third-party software and licenses. If your purchase included a software license or third-party service that we bought on your behalf and delivered to you (for example, a Profile Builder license, a plugin license, or a paid SaaS seat), the actual cost we paid for that license or service will be deducted from your refund. The license or service itself is not returnable to the third-party vendor once activated, so this deduction is necessary to issue an otherwise valid refund.

If you purchased on a payment plan in the past and your refund request falls outside the window, any remaining scheduled payments are still due in full.

5. Payment

Payment is processed through our payment provider at checkout. Your plan, its price, and any renewal schedule are shown at checkout and confirmed in your receipt email.

Failed renewal charges. If a FOCUSED Pro renewal charge, or a scheduled charge on a payment plan bought in the past, fails, we will retry the charge and notify you by email so you can update your payment method. If the failed balance remains unpaid for more than 7 calendar days, your access to the membership, course, or product covered by that charge will be paused until the outstanding balance is paid in full. Once the balance is settled, email support@focusedsketchup.com from the address on your account and we will restore your access. Pausing access for non-payment does not cancel any remaining payment obligations under a payment plan.

You are responsible for keeping your billing information accurate and up to date.

6. Your Account

You are responsible for keeping your login credentials secure and for all activity on your account. If you believe your account has been compromised, contact us immediately.

Account sharing is a violation of these Terms. If we detect or have reasonable belief that an account is being shared, we may suspend or terminate access without refund.

7. The Student Community

FOCUSED Pro and course purchases include access to the student community inside the FOCUSED SketchUp Learn portal — a discussion forum and a comment thread on each lesson. Participation is optional. It is subject to the community guidelines posted at learn.focusedsketchup.com/guidelines, and we may remove content or suspend community access for anyone who violates them. Suspension of community access for a guidelines violation does not by itself remove your access to the course content you purchased. For FOCUSED Pro members, community access lasts as long as the membership is active.

By posting in the community you grant us a non-exclusive, royalty-free license to share, reproduce, and display your post in connection with the community and our marketing.

The private FOCUSED SketchUp Facebook group this community replaced was retired in September 2026. Posts from that group may appear in the portal community, attributed to the member who originally wrote them.

8. Reviews and Testimonials

If you submit a review, testimonial, or other feedback through any channel, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and quote that content in our marketing — with attribution to your first name and (if you provide it) your business or city.

9. Acceptable Use

You agree not to use the Products or the website to:

• Violate any law or third-party rights, including intellectual property rights.
• Harass, abuse, or threaten any person.
• Distribute malware or interfere with the security or operation of the website.
• Attempt to bypass paywalls, license checks, or security tools.
• Impersonate any other person or entity.

10. Intellectual Property

All Materials — including video lessons, written content, downloadable files, 3D models, templates, course branding, and the FOCUSED SketchUp marks — are owned by FOCUSED by John Kaplar LLC (FOCUSED SketchUp) and protected by copyright and other laws. Nothing in these Terms transfers ownership of any of our intellectual property to you.

11. Third-Party Tools and Software

Our courses reference and use third-party software (such as SketchUp, V-Ray, D5 Render, AI tools, and others). You are responsible for separately licensing any third-party software you use. We may earn affiliate commissions from third-party links; this never changes what we recommend.

Some Materials may include third-party 3D models, textures, or assets (for example, items sourced from 3D Warehouse). We do not claim ownership of those third-party assets and disclaim any warranty as to their suitability for commercial use. You are responsible for verifying licensing before using any third-party asset commercially.

12. No Guarantee of Results

Our Materials are educational. We do not guarantee any specific business, financial, or design outcome from using them. What you achieve depends on your effort, your prior skill, your market, and many factors outside our control.

13. Disclaimer of Warranties

The Products and the website are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Products will be uninterrupted, error-free, secure, or that they will meet your specific requirements.

14. Limitation of Liability

To the maximum extent permitted by law, FOCUSED SketchUp will not be liable for any indirect, incidental, special, punitive, or consequential damages arising from your use of the Products, including lost profits, lost data, or business interruption. Our total liability for any claim relating to a Product is capped at the amount you paid for that Product in the six (6) months before the claim arose.

Some jurisdictions do not allow the limitation of certain damages, so parts of this section may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless FOCUSED SketchUp and its owners, employees, and contractors from any claims, damages, or costs (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of the Products, or your violation of any law or third-party right.

16. Service Availability

We may need to interrupt access for maintenance or to address security issues. We will try to schedule planned downtime outside peak hours but make no guarantee. We are not liable for any loss caused by downtime.

17. Termination

We may suspend or terminate your access to any Product at any time if you violate these Terms, including for credential sharing, redistribution of Materials, abuse of the refund policy, or chargebacks. Termination for cause does not entitle you to a refund.

You may stop using the Products at any time. Active subscriptions, including FOCUSED Pro Monthly and Yearly plans, can be cancelled at any time and will not renew at the next billing date; access continues through the end of the current paid period and then ends, as described in Section 3.

18. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of any Product after a change means you accept the updated Terms.

19. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute that cannot be resolved between us in good faith will be submitted to binding arbitration in Loudoun County, Virginia, before a single arbitrator under the JAMS Streamlined Arbitration Rules. Each party bears its own costs. Intellectual-property claims may be brought in court instead of arbitration. The parties waive any right to a jury trial for arbitrable claims.

20. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later. These Terms — together with the Site Terms of Service and Privacy Policy — are the entire agreement between you and FOCUSED SketchUp regarding the Products. You may not assign your rights under these Terms; we may assign ours in connection with a sale or restructuring of the business.

21. Branded Content in the FOCUSED 3D Library

From time to time the FOCUSED 3D Library includes content that references, represents, or approximates products from real, third-party brands. This falls into three groups, referred to together as "Branded Content":

• Branded Models — 3D models that visually represent a real product (for example, Sub-Zero^® and Wolf^® appliances).
• Branded Materials — SketchUp materials named after a manufacturer's paint or finish colors (for example, Benjamin Moore^®, Sherwin-Williams^®, Farrow & Ball^®, and Stoffer Home Cabinetry^®).
• Branded Profiles and Resources — trim, moulding, and profile files that approximate a supplier's published millwork profiles (for example, Home Depot^® and TW Perry^®), including files intended for use with third-party extensions such as Profile Builder.

Branded Content is provided to library members as a convenience for use in design mockups, renderings, and client presentations.

How Branded Content was created. Each Branded Model was hand-modeled by us in SketchUp using product specifications, photographs, and dimensional information that the brand publishes for the public on its own website and other publicly available sources. Each Branded Material is our own approximation of a color, matched by eye from publicly published color images — we do not use, license, or reproduce any manufacturer's measured color data, spectral data, formulation, or color file. Each Branded Profile was drawn by us from publicly published profile drawings and photographs. We do not use, copy, redistribute, or derive any Branded Content from CAD files, BIM files, Revit families, SKP files, color databases, or any other digital design files supplied or licensed by the brand. No proprietary digital file from any brand is incorporated into any Branded Content.

No affiliation, endorsement, or partnership. FOCUSED SketchUp is not affiliated with, endorsed by, sponsored by, or in any way associated with Sub-Zero, Wolf, Benjamin Moore, Sherwin-Williams, Farrow & Ball, Stoffer Home Cabinetry, Home Depot, TW Perry, or any other brand, manufacturer, retailer, or supplier whose products may be represented in or referenced by the FOCUSED 3D Library. All product names, brand names, color names and numbers, profile designations, trademarks, trade dress, and logos are the property of their respective owners and are used only nominatively to identify the product, color, or profile a piece of Branded Content is intended to approximate. We claim no ownership of, and assert no rights in, any third-party brand's product design, colors, trademarks, or trade dress.

No guarantee of accuracy. Branded Content is provided "as is" for design-visualization purposes only. It represents our interpretation of a product, color, or profile, and it may be inaccurate. We do not guarantee, warrant, or represent that the dimensions, proportions, clearances, connection points, materials, finishes, color values, sheen, texture, profile shapes, or any other characteristic of any Branded Content match the actual physical product. Specifications and color ranges change, our content may not reflect the most current version of a product or color, and differences between our content and the real thing are expected.

Color will not match a physical sample. Branded Materials are not official colors and must not be treated as a color reference. Beyond our approximation itself, what you see depends on your monitor, its calibration, your operating system's color management, the lighting in your scene, and the render engine and settings you use — the same material will display differently on two machines. Before specifying, ordering, or presenting a color as a final selection, obtain a physical sample, drawdown, or fan deck chip from the manufacturer or an authorized retailer and confirm the color in the actual space.

You must verify before ordering, specifying, or fabricating. You agree to independently verify all dimensions, clearances, rough-opening requirements, electrical, plumbing, and ventilation specifications, profile shapes and dimensions, color selections, and any other attribute against the brand's official published specifications and physical samples before ordering a product, specifying it on a construction document, sending anything to a fabricator or millwork shop, presenting it as a final selection to a client, or relying on it for any real-world installation. Branded Content is a design-presentation tool, not a substitute for the manufacturer's spec sheet, color sample, or profile drawing.

Use at your own risk. Your use of any Branded Content is entirely at your own risk. Without limiting Sections 13 (Disclaimer of Warranties), 14 (Limitation of Liability), or 15 (Indemnification) above, FOCUSED SketchUp shall not be liable for any loss, cost, claim, delay, or damage of any kind — including ordering mistakes, mis-specified or mismatched colors, repainting or refinishing costs, fabrication or installation errors, rejected change orders, client refunds, or any direct, indirect, incidental, or consequential damages — arising from or related to your use of any Branded Content.

Indemnification specific to Branded Content. In addition to Section 15 above, you agree to defend, indemnify, and hold harmless FOCUSED SketchUp from any claim by a third party (including a brand owner, manufacturer, retailer, distributor, or end customer) arising from your use, modification, redistribution, or commercial exploitation of any Branded Content — including any claim of trademark infringement, copyright infringement, false endorsement, unfair competition, or design rights — where the claim arises from your specific use of the content rather than from our act of providing it.

Removal on request. If a brand owner believes a piece of Branded Content infringes its rights or otherwise objects to its inclusion in the FOCUSED 3D Library, the brand owner or its authorized agent may contact us at support@focusedsketchup.com and we will review the request in good faith and, where appropriate, remove or revise the content.
